Tobias Heinel-Yde
Tobias specialises in construction law and has for many years acted in some of Denmark’s largest and most complex construction and infrastructure disputes. He advises and represents employers, main and turnkey contractors, consultants and technical suppliers in disputes arising out of major construction projects, including commercial developments, public infrastructure and highly technical works.
Tobias has extensive experience conducting arbitration proceedings before the Danish Building and Construction Arbitration Board, the Danish Institute of Arbitration and international arbitral institutions, including the ICC. He also represents clients before the Danish courts. He is an experienced litigator accustomed to handling disputes involving substantial financial exposure, extensive evidentiary records, complex technical issues and multiple parties.
His practice includes disputes relating to defects, delay, variations and additional works, project changes, allocation of liability between contractors and consultants, and claims for damages and recourse in multi-party settings. Tobias has particular expertise in advisor liability within the construction sector and manages cases requiring integration of detailed technical assessments with a focused litigation approach.
In addition to formal dispute resolution, Tobias advises clients strategically from the early stages of a project and throughout the construction phase to prevent and manage disputes. He advises on contractual frameworks (including the Danish AB standards), risk allocation, claims management, documentation strategy, preservation of evidence and overall dispute strategy.
Tobias is recognised for his analytical approach and ability to create clarity in technically and factually complex matters. He works closely with clients’ technical and commercial teams and external experts to ensure coherent and effective dispute handling - from early case assessment and settlement negotiations to final resolution by arbitration or the courts.
