Fibia enters into new contractual framework for fibre wholesale network - Nuuday is first service provider

Fibia has opened its fibre network and has entered into the first wholesale agreement with Nuuday. Due to the wholesale agreement all customers on Fibia's network will be able to choose products from Nuuday from the beginning of the new year. The new collaboration will provide 500,000 families and businesses with new opportunities for delivery of broadband. Plesner advised Fibia on the drafting of the wholesale agreement and was also involved in the negotiations between Fibia and Nuuday.

Fibia is energy providers NRGi and SEAS-NVE's new fibre network company which has a comprehensive fibre network infrastructure in large parts of Zealand, the intervening islands and eastern Jutland. Fibia previously only provided access to Waoo but the new wholesale agreement with Nuuday is to ensure that Fibia's customers get even more freedom to choose between broadband services (internet connections, television and telephony) and is to help strengthen Fibia's position as the largest provider of high-speed connections.

Plesner advised Fibia on the drafting of the contractual framework and provided other legal advice, including advice on regulatory aspects and competition law aspects.

Fibia and Nuuday are now putting the finishing touches to the practical details, and Nuuday's product "Hiper" is expected to become available to all Fibia's networks at the beginning of 2021, and it will also be possible to provide YouSee and TDC Business on Fibia's fibre infrastructure in 2021.

It is Fibia's intention to use the wholesale agreement as a standard agreement in connection with Fibia's future collaborations with other broadband service providers for the purpose of giving Fibia's customer's even more freedom of choice in the future.

Plesner also advised Fibia with respect to the dialogue with authorities in connection with Fibia's opening of its fibre network.
