New guidelines - evaluation models in public procurement

On 11 March 2016, the Danish Competition and Consumer Authority issued guidelines for the use and planning of evaluation models in public procurement.

With the coming into force of section 160 of the Danish Public Procurement Act, it has become mandatory for public contracting entities to describe the evaluation model that is contemplated to be used to identify the most economically advantageous tender already in the tender documents.

The object of the new rules is to increase the transparency of public procurement, but they also entail a number of challenges for the contracting entities because, among other things, the model is binding (and consequently makes the tender evaluation less flexible) unless alternative models have been taken into account in the tender documents.

The Danish Competition and Consumer Authority's guidelines contain an account of the legal framework applying to the evaluation of tenders and practical advice on how, for example, to choose between the different models, how to plan an evaluation model, the type of evaluation model suitable for various types of procurement, the circumstances in which alternative evaluation models can be used as well as a large number of other issues.

The Danish Competition and Consumer Authority has also prepared a "Method Calculator" to be used as a support tool to decide which model to use and to test and compare the various evaluation models.
