New Standard Forms of Construction Contracts in Denmark

On Friday 2 February 2018, the committee that has prepared the new standard construction contracts for the Danish construction market - also known as the "AB-standards" - published its consultation draft. 

As the current AB-standards from 1992 are largely applied in the Danish construction industry, the new AB-standards have been highly anticipated.

The new AB-standards consists more specifically of three types of general conditions; AB18 which apply to construction contracts , ABT18 which apply to turnkey construction contracts and ABR18 which apply to technical consultancy contracts. The consultation draft for the revision of ABT93, i.e. the ABT18, is however expected published at a later time.

As such, the AB-standards are agreed documents (and not by definition legislation) and not mandatory in any respect. However, the AB-standards have been negotiated between the various interest groups in the construction industry and are normally perceived as balanced documents.

Upon closing of the consultation period in March 2018 it is expected that the AB-standards will be issued in their finally form in May 2018.
